Terms of Service

These terms form an agreement between you and FixedLayer Lab covering your use of ClearMail.

1.Acceptance of these terms

These Terms of Service (the “Terms”) are a binding agreement between you and FixedLayer Lab (“FixedLayer Lab”, “we”, “us”), the operator of ClearMail(the “Service”). By creating an account, connecting your Google account, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you are using ClearMailon behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and “you” refers to that organisation.

2.What ClearMail does

ClearMail connects to your Gmail mailbox and helps you understand and reduce what is in it. The Service lets you analyse your mailbox by sender, see which senders consume the most storage, unsubscribe from newsletters, apply Gmail filters, and archive or delete messages in bulk.

ClearMail is an independent product. It is not affiliated with, endorsed by, or sponsored by Google LLC. Gmail and Google are trademarks of Google LLC.

3.Eligibility and your account

  • You must be at least 16 years old, and old enough to form a binding contract where you live, to use the Service.
  • You are responsible for everything that happens under your account and for keeping your Google account credentials secure.
  • You must provide accurate information and tell us promptly at support@fixedlayer.com if you suspect unauthorised use of your account.
  • One person or organisation per account; do not share your account credentials with others.

4.Connecting your Google account

The Service works by calling the Gmail API with an OAuth token you grant us. By connecting your account, you authorise ClearMailto access and modify your mailbox within the scopes shown on Google’s consent screen and itemised in our Privacy Policy.

Your use of Gmail remains governed by your agreement with Google. You are responsible for ensuring you have the right to connect the mailbox you connect — for example, that your employer permits it if it is a work account. You may revoke our access at any time from Settings or at myaccount.google.com/permissions. Revoking access will stop the Service from functioning.

5.Deletion and other irreversible actions

Please read this section carefully

ClearMail can delete and archive email in bulk. Deletion moves messages to your Gmail Trash, where Google permanently removes them after roughly 30 days. Once Gmail purges a message, neither we nor Google can recover it.

You are solely responsible for reviewing your selections before confirming a cleanup action. We strongly recommend reviewing the sender list and message counts shown in the confirmation step, and keeping your own backup of anything you cannot afford to lose. To the fullest extent permitted by law, FixedLayer Lab is not liable for the loss of email resulting from actions you initiate through the Service.

6.Acceptable use

You agree not to:

  • Access a mailbox you are not authorised to access, or use the Service to surveil, harvest, or resell another person’s email data.
  • Use the Service to send spam, phishing messages, or any unlawful, harassing, or infringing content.
  • Reverse engineer, decompile, scrape, or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by law.
  • Interfere with or disrupt the Service, circumvent rate limits, or probe our systems for vulnerabilities without written permission.
  • Resell, sublicense, or provide the Service to third parties as your own product without our written agreement.
  • Violate the Gmail API terms, Google’s policies, or any applicable law or regulation.

7.Privacy

Our handling of your data — including the specific Gmail scopes we request and our Limited Use commitments under the Google API Services User Data Policy — is described in our Privacy Policy, which forms part of these Terms.

8.Fees and paid plans

ClearMail may offer both free and paid plans. If you subscribe to a paid plan, you authorise us to charge the payment method you provide on a recurring basis until you cancel. Fees are stated exclusive of taxes unless noted, and are non-refundable except where required by law or expressly stated at the time of purchase. We will give you reasonable advance notice before changing the price of an existing subscription; continuing to use the Service after the change takes effect constitutes acceptance of the new price.

9.Intellectual property

The Service, including its software, design, and brand, is owned by FixedLayer Lab and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose while these Terms are in effect.

Your content stays yours. We claim no ownership over your email or the data in your mailbox. You grant us only the limited licence needed to operate the Service for you — to process your mailbox data in order to provide the features you use. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them to improve the Service.

10.Third-party services

The Service depends on third-party providers, including Google (Gmail API), Supabase, and our hosting provider. Their availability and behaviour are outside our control, and FixedLayer Lab is not responsible for outages, changes, or losses caused by them. Links to third-party sites — including unsubscribe links in your email — are provided for convenience only and are not endorsements.

11.Availability and changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may add, modify, suspend, or discontinue features at any time. If we discontinue the Service entirely, we will give you reasonable notice and a chance to export your data where practicable.

12.Termination

You may stop using the Service and delete your account at any time from the Settings screen. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if your use poses a security risk to the Service or to other users. On termination, your right to use the Service ends immediately, and we will delete your data as described in our Privacy Policy. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

13.Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that storage estimates and analytics will be accurate, or that every unsubscribe request will be honoured by the sender.

14.Limitation of liability

To the fullest extent permitted by law, FixedLayer Lab and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, or data — including deleted email — arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) one thousand Indian Rupees (₹1,000). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15.Indemnification

You agree to indemnify and hold harmless FixedLayer Lab and its personnel from any claims, damages, liabilities, and reasonable legal fees arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

16.Governing law and disputes

These Terms are governed by the laws of India, without regard to its conflict of law principles. Subject to the paragraph below, the courts located in India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to their personal jurisdiction.

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at contact@fixedlayer.com. We will try to resolve it with you in good faith within 30 days. Nothing in this section prevents either party from seeking injunctive relief to protect its intellectual property rights.

17.Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.
